Land Administration Act 1997

The Land Administration Act 1997 (LAA) (external link) is the State’s legislation providing for disposition and management of State land. This Act is administered by the Minister in her statutory role as Minister for Lands.

The LAA outlines all processes relating to:

  • reserves;

  • roads;

  • sales, leases and licences;

  • pastoral leases;

  • easements;

  • compulsory land acquisition;

  • compensation;

  • repeals, transitional, savings and validations; and 

  • reserving Crown land for a specific purpose.

Land Administration (Land Management) Regulations 2006

The following legislation provides for disposition and management of State land.

The Land Administration (Land Management) Regulations 2006 (external link) apply to:

  • unallocated State land.

  • unmanaged reserves, except those that for which the care, control or management is provided under another Act; and 

  • schedule 1 reserves – managed reserves to which these regulations apply.

The regulations cover:

  • authorisation under another written law;

  • authorised persons;

  • camping;

  • commercial activities, advertising, collecting money;  

  • directions;

  • fires;

  • general behaviour;

  • obstructing or impersonating an authorised person;

  • offences relating to Schedule 1 reserves (managed reserves to which these regulations apply);

  • permissions;

  • protection of plants and animals;

  • protection of property;

  • protection of the environment;

  • races, meetings;  

  • removing obstructions;

  • signs; and 

  • vehicles.

Land Administration Regulations 1998

The following legislation provides for disposition and management of State land.

The Land Administration Regulations 1998 (external link) cover:

  • telecommunications network services prescribed as public utility services;

  • conditions of delegation by Minister of powers to convey or transfer fee simple in State land;

  • procedures to be followed by local government before requesting acquisition of alienated land designated for public purpose;

  • procedures to be followed by local government before requesting acquisition of private road;

  • procedures to be followed by local government before requesting acquisition of alienated land in a townsite;

  • preparation and delivery by local government of request to dedicate land as a road; and

  • preparation and delivery by local government of request to close a road permanently.
