State land practices and procedures
The aim of the information provided in this section is to set in place standards and guidelines for the administration and registration of State land in Western Australia (WA).
WA has around 38% of the nation’s State lands. 93% of land in WA is State land whether unallocated or subject to reservation, dedication or leasing. These statistics illustrate both the opportunities and the challenges facing government land administration in WA.
The Land Administration Act 1997 (LAA) (external link) is the main statute governing the administration of State land in Western Australia.
The information provided should be read in conjunction with the LAA itself, the Transfer of Land Act 1893 (external link), the Land titles registration practice manual, and where applicable, Survey and plan practice manual.
Where appropriate, the relevant chapter(s) of the State land administration and registration practice manual have been provided for each State land action. The first part of each chapter sets out the business processes and administrative requirements of State land administration under the LAA. The second part of each chapter sets out the registration requirements as they affect the business processes in each Part of the LAA and will be required to enable conveyances and other dealings in State land to be registered under the Torrens system of land registration in order to be effective.
Where registration procedures are required, Chapter 2 of the State land administration and registration practice manual, together with the relevant chapter affecting the particular State land action, should be read in conjunction with the relevant paragraphs of the Land titles registration practice manual.
