Sales, leases and licences

Legislative overview

The Land Administration Act 1997 (LAA) (external link) is the State’s legislation dealing with the disposition of State land.

  • Part 6 of the LAA provides for the sale of State land.

  • Part 9 of the LAA provides for the acquisition and disposition of land for public work purposes.

  • Parts 4, 5 and 6 of the LAA provide for the granting and administration of leases over unmanaged reserves, State land, and public roads.

  • Part 7 deals with pastoral leases.

Our role

LandCorp is the State government’s land developer, however the Department is still responsible for:

  • the release and administration of leases over State land, including regular inspections to ensure compliance with lease condition; and 

  • playing a significant role in the administration, assembly and allocation of State land including creation and sale of superlots of State land within set parameters, conveyancing, and State land solutions (to assist local Government and other government agencies).

Administration and management procedures and practices

Chapter 6 of the Crown land administration and registration practice manual provides detailed information on sales, leases and licences, including:

  • who can sell and lease State land;

  • sale of fee simple interests in State land;

  • sale and amalgamation;

  • lease of crown land;

  • conversion of State land leases into the freehold;

  • licences and profits á prendre granted over State land; 

  • effect of improvements on termination of lease or licence; and 

  • general dispositions provisions.
